Judge Won't Stop Payments Under Dallemand Contract

A Bibb County Superior Court judge has turned down a Lizella man's request to stop all payments to the school district's superintendent under his contract.

Brad DeFore filed a lawsuit last month asking for a preliminary injunction on any further payments under Romain Dallemand's 2013 and 2011 contracts.

School district attorneys argued the judge should deny that request because Dallemand is a necessary party in the suit and should have a say in the deliberations over his contract.

Wednesday afternoon, Judge Edgar Ennis agreed with the school district. He writes, "Without participation in the instant suit, Dr. Dallemand will be unable to effectively protect his interests."

Ennis has yet to rule on the part of DeFore's suit alleging that Dallemand's contracts violate the state constitution and should be void.

DeFore's attorney Charles Cox has three weeks to amend the lawsuit and name Dallemand as a party in the legal action.
