U.S. Attorney: Macon officer justified in killing Sammie Davis | News
Federal prosecutor Michael Moore released a statement Tuesday afternoon stating that his office has reviewed evidence in the case including DNA, ballistics and witness statements.
Moore says there's no proof that Officer Clayton Sutton used unnecessary force in the shooting outside the Kroger on Pio Nono Avenue.
A GBI investigation also cleared Sutton.
They said the officer was in fear of his life.
"Based on the totality of the evidence, including DNA evidence, the government could not prove, beyond a reasonable doubt, that the officer willfully used more force than he believed was necessary under the circumstances," Moore stated in the Tuesday news release.
Bibb County Sheriff David Davis told 13WMAZ Officer Sutton will be off street duty in the new consolidated law enforcement. He says that's common practice when an officer involved in a shooting.
